By entering into aSales Agreementwith Medicasimple Healthcare Technologies Limited (“we,” “us,” or “our”) or by using any portion of the Services, you (“you,” “your,” or “Practice”) agree to be bound by these Terms. Where relevant, certain jurisdiction-specific terms may also apply based on the location of your practice, as set out in your Sales Agreement.
Important: These Terms do not override your local statutory rights or any mandatory laws. If you do not agree, you must cease use of Medicasimple’s products and Services immediately.
In these Terms, unless the context otherwise requires, the following words and expressions shall have the meanings set out below:
3.1Subscription Charges
Your subscription charges (“Subscription Fee”) begin on the date you activate your subscription. We will bill you on activation, and thereafter:

3.2Subscription Fee & Taxes

You agree to provide us with a valid payment method (e.g., Direct Debit mandate, credit card) for the payment of the Subscription Fee. Depending on your location, this may include a validBACSorSEPAmandate.
3.4Termination of Subscription
If you terminate your subscription, you (and any authorised Users) will continue to have access to the subscribed Services for the remainder of the current billing period. After the renewal date, access will cease unless you pay the applicable Subscription Fee to reactivate your subscription.
3.5No Partial Refunds
No refunds or credits will be issued for partial periods of service, upgrade/downgrade refunds, or unused subscription time, including cases where you remove a User—subject always to any applicableNon-Excludable Rights.
3.6Cancellation Timing
Subscriptions cancelled before the end of the current billing cycle will not incur further charges in the next cycle.
3.7Subscription Changes
The amount charged on the next billing cycle will reflect any requested changes to your subscription (including upgrades or downgrades). Changes may result in a loss of access to certain Content or features, or an adjustment to storage capacity or other resources.
3.8Fee Changes & Notice
All prices are subject to change upon at least thirty (30) days’ notice, which may be provided via email to the Administrator or via an announcement on the Services. If the price is increased, you may terminate the affected subscription before the price change takes effect.
3.9Taxes
You are responsible for paying all taxes associated with your subscription. If we are legally required to pay or collect taxes for which you are responsible, we will invoice you for the appropriate amount, unless you provide a valid tax exemption certificate.
3.10Gross-Up
All payments under the Sales Agreement shall be made free and clear of any taxes or withholdings. If you are required to deduct or withhold taxes, the payment amount shall be increased so that, after all deductions, we receive an amount equal to the sum we would have received had no deduction or withholding been necessary.
3.11API Use
Note: This section applies if you subscribe to Support and Maintenance Services in your Sales Agreement or if support is included as part of your SaaS (Cloud) subscription.
4.1Coverage
Subject to timely payment of applicable fees and compliance with these Terms, we agree to provide support for thePractice Software(and, if applicable,Cloud Software) installed or used at your Practice from the date of installation or activation.

If we agree to provide any of the above, we may charge for it at our standard rates, plus travel and accommodation (if applicable).
You agree to:
If Support Services are terminated or lapse, you may be subject to a “recommencement fee” to update your Practice Software to the latest specifications before we can resume support. The fee will be based on our prevailing rates at the time.
We may subcontract any of the Support Services to a qualified third party without your prior written consent. Unless otherwise notified, third-party costs are included in your monthly Support Fee.
Unless a different term is specified in your Sales Agreement, Support Services are provided for an initial term of 12 months from theEffective Date(“Support Service Term”). At the end of this term, the Support Services contract will automatically renew on a monthly basis unless you notify us in writing at least thirty (30) days before renewal of your intent to terminate.
By using this Website, you warrant on behalf of yourself, your Users, and other parties you represent that you will not:
The intellectual property in the materials contained in this Website are owned by or licensed to Medicasimple Healthcare Technologies Limited and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.
This constitutes the grant of a licence, not a transfer of title. This licence shall automatically terminate if you violate any of these restrictions or these Terms, and may be terminated by Medicasimple Healthcare Technologies Limited at any time.

To the extent permitted by law, Medicasimple Healthcare Technologies Limited makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.
In no event shall Medicasimple Healthcare Technologies Limited or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this Website or the materials on this Website, even if Medicasimple Healthcare Technologies Limited or an authorised representative has been notified, orally or in writing, of the possibility of such damage.

These Terms are governed by and construed in accordance with the laws of the United Kingdom. You irrevocably submit to the exclusive jurisdiction of the courts in that location.
Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by events beyond its reasonable control (including natural disasters, governmental actions, war, civil unrest, acts of terrorism, labour disputes, or internet service disruptions). The affected party shall promptly notify the other party in writing, providing details of the circumstances and the anticipated duration of the delay.
This acceptable use policy covers the products, services, and technologies (collectively referred to as the “Products”) provided by Medicasimple Healthcare Technologies Limited under any ongoing agreement. It’s designed to protect us, our customers, and the general internet community from unethical, irresponsible, and illegal activity.
Medicasimple Healthcare Technologies Limited customers found engaging in activities prohibited by this acceptable use policy can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such customers to the relevant authorities.

We provide our facilities with the assumption your use will be “business as usual,” as per our offer schedule. If your use is considered excessive, additional fees may be charged or capacity may be restricted.
We are opposed to all forms of abuse, discrimination, rights infringement, and/or any action that harms or disadvantages any group, individual, or resource. We expect our customers and, where applicable, their users (“end-users”) to likewise engage our Products with similar intent.
We regard our customers as being responsible for their own actions as well as for the actions of anyone using our Products with the customer’s permission. This responsibility also applies to anyone using our Products on an unauthorised basis as a result of the customer’s failure to put in place reasonable security measures.
By accepting Products from us, our customers agree to ensure adherence to this policy on behalf of anyone using the Products as their end users. Complaints regarding the actions of customers or their end-users will be forwarded to the nominated contact for the account in question.
If a customer — or their end-user, or anyone using our Products as a result of the customer — violates our acceptable use policy, we reserve the right to terminate any Products associated with the offending account or the account itself, or take any remedial or preventative action we deem appropriate without notice. To the extent permitted by law, no credit will be available for interruptions of service resulting from any violation of our acceptable use policy.
Copyright infringement and access to unauthorised material
Our Products must not be used to transmit, distribute, or store any material in violation of any applicable law. This includes but isn’t limited to:
SPAM and unauthorised message activity
Our Products must not be used for sending unsolicited bulk or commercial messages in violation of applicable laws and regulations (“spam”). This includes but isn’t limited to sending spam, soliciting customers from spam sent from other service providers, and collecting replies to spam sent from other service providers.
Our Products must not be used to run unconfirmed mailing lists or telephone number lists (“messaging lists”). This includes but isn’t limited to subscribing email addresses or telephone numbers to any messaging list without the permission of the email address or telephone number owner. All messaging lists run on or hosted by our Products must be “confirmed opt-in.”
Unethical, exploitative, and malicious activity
Our Products must not be used for intentionally introducing viruses or malicious code, accessing unauthorised accounts, or engaging in denial-of-service attacks, hate speech, or any activity intended to threaten, abuse, or discriminate against individuals or groups. Unauthorised access or alteration of data is strictly prohibited.
Unauthorised use of Medicasimple Healthcare Technologies Limited property
We prohibit the impersonation of Medicasimple Healthcare Technologies Limited or misrepresenting a significant business relationship with us for fraudulent or deceptive purposes.

At Medicasimple, we strive to ensure that you are satisfied with our service. However, we understand that there may be instances where you need to request a refund, and we aim to make this process as seamless as possible.

Medicasimple hizmetlerinden faydalanmaya başlamak üzere, çevrimiçi deneme hesabı formu göndererek veya ücretli üyelikle ilgili çevrimiçi satın alma gerçekleştirerek bu sözleşme şartlarını kabul etmiş olursunuz. Ücretli veya ücretsiz olarak Medicasimple hizmetlerinden faydalanmaya devam ederek, bu sözleşme şartlarını da kabul etmiş sayılacaksınız. Müşteri, işbu Hizmetleri kendi riskiyle kullanır. İşbu Hizmetler Müşteri’ye “olduğu gibi” ve “mevcut haliyle” sunulmaktadır.
Medicasimple, Yazılımı, web sitesini, mobil uygulamaları ve paneli usulünce işletmek, verileri işbu sözleşmenin geçerli olduğu süre boyunca muhafaza etmek ve veri toplama ve muhafaza işinin sağlıklı bir biçimde icra edildiğini gözetmekle mükelleftir.
Medicasimple’un işbu Hizmetleri sağlayabilmek için üçüncü kişiler tarafından üretilen yazılım ve donanımları kullanmak hakkına sahiptir. Müşteri, bu yazılım ve donanımların kısmen yahut tamamen çalışmaması sebebiyle ortaya çıkacak eksiklik ve gecikmeler nedeniyle Medicasimple’un sorumluluğu olmayacağını peşinen kabul eder.
Müşteri, Medicasimple’un, Müşteri ve kullanıcıları da dahil web sitesini ziyaret eden kimselerin giriş IP, tarayıcı, giriş tarih ve saat bilgilerini kayıt ve muhafaza edeceğinin bilincinde olduğunu ve bu bilgilerin saklanması, üçüncü kişilerle paylaşım ve sözleşme gereklilikleri ve Medicasimple’un yasadan doğan mükellefiyetlerinin yerine getirilmesi amacı başta olmak üzere her çeşit kullanımına peşinen muvafakat ettiğini kabul ve beyan eder.
Müşteri, kendisine ait her çeşit bilginin, Medicasimple tarafından -anonimleştirmek suretiyle- sistemlerini iyileştirmek ve üçüncü kişiler ile paylaşımına peşinen izin verdiğini, böyle bir kullanımın işbu sözleşmenin başta “gizlilik” hükümleri olmak üzere hiçbir hükmüne aykırılık teşkil etmediğini ve bu nedenle Medicasimple’un hiçbir suretle tazminat ve sair ödenti altına girmiş kabul edilmeyeceğini beyan ve taahhüt eder.
Müşteri, toplanan verilerin kendi tayin ettiği sınırlar dairesinde ve kendi istihdam ettiği personel eliyle toplandığının ve bu verilerin hak sahiplerinin kullanıcılar ve müşteriler olduğunun bilincinde hareket eder.
Buna göre Müşteri, verilerin hak sahiplerine başta Kişisel Verilerin Korunması Kanunu olmak üzere kanundan doğan her türlü bilgilendirmeyi sunmak ve açıklamak sorumluluğunun sadece kendisine ait olduğunu, bu konuda istihdam ettiği personeli bilgilendirmeyi ve verilerin toplanması ve saklanması başta olmak üzere, verilere dair mevzuattan doğan her türlü mükellefiyetin icrasının sorumluluğunu münhasıran üstlendiğini ve dahi işbu sözleşmenin “Verilerin Gizliliği” maddesindeki mükellefiyetinin baki olduğunu peşinen kabul beyan ve taahhüt eder.
Müşteri, bunlarla sınırlı olmamakla birlikte aşağıdaki faaliyetlerin yasak olduğunu kabul eder:
Medicasimple, ürün ve hizmetlerinin tanıtımı için sınırlı süreli “Ücretsiz Deneme Hesabı” sunabilir. Ücretsiz Deneme Hesabı kullanım hakkının sunumu ve şartları tamamen Medicasimple’un inisiyatifindedir ve önceden haber vermeden sonlandırılabilir. Her “Müşteri”, Ücretsiz Deneme Hesabı hakkından sadece bir kere faydalanabilir.
Ücretsiz Deneme Hesabı kullanım süresi sonunda, Müşteri isterse ücretli Medicasimple aboneliği başlatabilir. Müşteri Ücretsiz Deneme Hesabı sonunda ücretli Medicasimple aboneliği başlatmazsa, bu Sözleşme kendiliğinden sona erer, kendiliğinden yenilenmez, müşteri hesabı kapatılır ve Müşteri’ye ait veriler, kanunen saklanması gereken sürenin sonunda silinirler.
Müşteri Medicasimple hizmetlerine Medicasimple’un web sitesindeki ilgili bölümden gerekli formu doldurarak hesap açıp, abonelik başlatabilir. Medicasimple hizmetlerine abone olduğunuzda (“Abonelik”), Medicasimple tarafından tarafınıza sunulan hizmetlerin her kullanım dönemi sonunda otomatik olarak yenilenmesine izin vermiş ve bu hizmetlerle ilgili dönemsel ücretlerin Abonelik süresince ödeneceğini taahhüt etmiş olursunuz.
Medicasimple hizmetleri bireysel olarak veya şirket yetkilisi tarafından şirket adına satın alınarak ödemesi yapılır. Medicasimple hesabınızda Sistem Yöneticisi yetkisine sahip kullanıcılar gerektikçe diğer kullanıcılara yetki verebilir ya da alabilirler.
Medicasimple hizmetlerinden faydalanmak için geçerli bir kredi kartı ve/veya ön ödeme gereklidir. Her hizmet dönemi için ödeme ilgili dönemin başında alınır ve iade edilmez. Medicasimple, farklı hizmet paketleri için, farklı ödeme yöntemleri ve şartları belirleyebilir.
Medicasimple hesabında geçerli bir kredi kartı tanımlandıysa, ve Müşteri Medicasimple’u geçerli hizmet dönemi bitiminden önce aboneliğini iptal etmek istediğine dair bilgilendirmediği sürece, Medicasimple hizmetleriyle ilgili ücretler, zamanı geldiğinde otomatik olarak bu kredi kartından tahsil edilecektir.
Medicasimple ilgili ödeme yönetimine ait bilgileri, gelecekteki ödemelerin tahsilatlarında kullanmasına yönelik olarak sistemlerinde güvenli şekilde saklayabilir. Banka havalesiyle ödeme tercih edildiyse, alınan hizmetin kesintisiz sağlanabilmesi için, zamanı geldiğinde hizmet ödemesinin Müşteri tarafından ön ödeme yöntemiyle gerçekleştirilmiş olması gereklidir.
Medicasimple, ödeme dönemlerinde Müşteriye hatırlatıcı bilgilendirme mesajları gönderecektir, ancak bu mesajların Müşteriye ulaşmaması durumunda ödeme yükümlülüğünde bir değişiklik olmaz.
Mevcut kullanım dönemi içinde Müşteri tarafından, kullanıcı hakları veya kullanılan servislerle ilgili arttırma ve azaltma yapılabilir. Dönem içinde ilave servis alınması veya kullanıcı arttırımı yapıldığında, bir sonraki faturalama dönemine kadar kalan gün sayısı kadar kısmi faturalandırma işlemi yapılabilir.
Müşteri ödemesini yaptığı servis ve kullanıcıları ilgili dönem içinde kullanmaz veya servis/kullanıcıları sistemden silse dahi herhangi bir ücret talebinde bulunamaz. Eksik kullanım yapılan aylar, abonelik değişikliği ya da açık hesap ile kullanım yapılmayan aylar için iade yapılmaz ya da ek kredi verilmez.
Medicasimple, işbu sözleşme kapsamındaki ücretlerin ödenmemesi veya kesintiye uğratılması halinde Müşteri’nin kontrol paneline erişimini, önceden haber vermeden, kısmen veya tamamen kısıtlamak (hesabı askıya almak) veya akdi fesih haklarını saklı tutar.
Müşterinin hesabının yukarıdaki sebepten askıya alınması veya akdin fesih durumlarında, Medicasimple’un Müşteriye herhangi bir suretle maddi, manevi, müspet yahut menfi tazminat yahut sair ödenti ödemesi mükellefiyetini doğmayacaktır. Müşteri tarafından abonelikle ilgili yapılan her değişiklik hemen geçerli olur. Tüm ücretlere vergiler dahil değildir ve ek vergilerin ödenmesi Müşterinin sorumluluğundadır.
Bu hizmet, Türkiye Cumhuriyeti mevzuatına göre faturalanmaktadır.
Fatura kesildiği tarih itibariyle müşteri tarafından 3 aylık üst üste ödeme yapılmadığı takdirde Medicasimple sistemi askıya alma hakkına sahiptir." Müşterinin Medicasimple hesabı askıya alındığında, askıya alma tarihinden itibaren kırk (40) gün boyunca bilgileri sistemde korunur (yasalardan kaynaklanan belirli süre saklanması gereken bilgiler hariçtir). Müşteri hesabını bu süre içerisinden tekrar kullanmak isterse, Müşteri gerekli ödemeyi gerçekleştirdikten sonra hesap Medicasimple tarafından tekrar etkin hale getirilecek ve Müşteri bilgilerine ulaşabilir hale gelecektir. Müşteri bu süre zarfında gerekli ödemeyi yaparak hesabını etkin hale getirmezse, bu sürenin sonunda Müşterinin tüm bilgileri silinebilir ve tekrar bir daha geri getirilemeyebilir. Müşteri, kendi aboneliğini veya hesabını doğru bir şekilde iptal etmekten sorumludur. Herhangi bir zamanda Kontrol Paneli menüsündeki ilgili bölümden abonelik iptal edilebilir.İptal durumunda, Müşteri mevcut kullanım dönemi sonuna kadar Medicasimple hizmetlerini kullanmaya devam edebilir, dönem sonunda abonelik sonlanacak ve tekrar faturalandırma gerçekleştirilmeyecektir. E-posta ya da telefon yoluyla gönderilen abonelik değişikliği veya iptal taleplerini Medicasimple işleme koyup koymamakta serbesttir. Müşterinin, hesabın askıya alınması veya iptali durumlarında, yukarıda belirtilen, bilgilerin silinmesinden önceki süreler dahilinde, sistemde kayıtlı bilgileri Medicasimple'dan talep ederek veya sistemden dışa aktarım araçlarını kullanarak alma sorumluluğu tamamen kendisine aittir. Bilgilerin Müşteri'ye hangi formatta teslim edileceğini Medicasimple belirler. Medicasimple, kanuni yükümlülüklerin sağlanması, çalışanların / hissedarlarının / iş ortaklarının / tedarikçilerinin güvenliğinin ve haklarının korunması, hizmetlerin devamlılığının sağlanmasına, hataların giderilmesine veya diğer müşteri / kullanıcıların haklarının korunması ve güvenliğinin sağlanmasıyla ilgili acil ve gerekli gördüğü durumlarda önceden haber vererek ya da vermeden, Herhangi bir zamanda Müşterinin hesabını kapatabilir ya da tüm hesaba ya da bir bölümüne ulaşımını engelleyebilir. Bu şekilde Hizmetlerin kapanması, hesabın dondurulması ya da silinmesi, hesaba erişimin engellenmesi, Müşterinin hesabındaki tüm içerikler üzerindeki haklarından feragat etmesini gerektirebilir. Müşteri böyle bir durumda Medicasimple'ın bir sorumluluğu olmayacağını peşinen kabul eder.
Medicasimple herhangi bir nedenle herhangi bir kişiye veya şirkete hizmet vermeme hakkını saklı tutar.
İşbu sözleşmede ifadesini bulan çalışma ve hizmet biçimleri Müşterinin seçtiği hizmet paketi içeriğinden ibarettir. Medicasimple, paket içeriklerini Müşteriye e-posta ve diğer iletişim kanallarından önceden bildirimde bulunarak dilediği zaman ve tek taraflı olarak değiştirmek hakkını saklı tutar. Medicasimple, Hizmetlerin devamlılığının sağlanmasına veya hataların giderilmesine yönelik v.b. acil durumlarda, Müşteri’ye önceden haber vermeden paket içeriklerinde değişiklik yapma hakkını saklı tutar. Paket ve Hizmetler içeriğinde Medicasimple tarafından tek taraflı olarak gerçekleştirilecek değişiklikler, Medicasimple’un Müşteri lehine hiçbir surette maddi, manevi, müspet ve menfi tazminat, ücret iadesi ve sair ödenti ödemesi mükellefiyetini doğurmaz.
Medicasimple ücretleri ya da ödeme şartlarını otuz (30) gün önceden haber vererek değiştirme hakkını saklı tutar. Medicasimple bu değişiklikleri kendi tercihine göre www.medicasimple.com web sitesinden ve/veya Müşteriyle iletişimde olduğu diğer kanallardan duyurur.
Medicasimple, işbu sözleşmede yer alan ücretler ve ödeme şartları dışında kalan şart ve sorumlulukları ve hizmet kapsamını dilediği zaman tek taraflı olarak değiştirmek hakkını saklı tutar. Müşteri, bu değişikliklerden kaynaklandığını öne sürerek Medicasimple’u zarar ve ziyandan sorumlu tutmayacağını peşinen kabul eder.
Müşteri, Medicasimple tarafından bu sözleşme kapsamında sunulan hizmetler “Olduğu Gibi” sunulduğunu peşinen kabul eder.
Medicasimple, Hizmetlerin devamlılığının sağlanmasına, hataların giderilmesine veya diğer Müşteri/kullanıcıların güvenliğinin sağlanmasıyla ilgili acil ve gerekli gördüğü durumlarda, herhangi bir zamanda habersiz olarak bakım, onarım, güncelleme çalışmaları ya da başka bir nedenden dolayı Hizmetleri kullanımınızı tamamen ya da kısmi olarak durdurabilir veya sınırlandırabilir. Bu sırada oluşabilecek herhangi bir kesinti ya da bilgi kaybından Medicasimple sorumlu değildir.
Mücbir sebepler:Medicasimple’un makul kontrolü dışında olan nedenler (doğal afet, genel grev, yaygın salgın hastalık, kısmi veya genel seferberlik ilanı v.b.) ile işbu Sözleşme kapsamındaki yükümlülüklerinden herhangi birini yerine getirememesi veya yerine getirmede gecikmesi halinde Medicasimple söz konusu yükümlülüklerin ifa edilmesinden ya da zamanında ifa edilmesinden sorumlu olmayacaktır.
Taraflar, işbu sözleşmede gösterilen hizmetler ve keza işbu sözleşmede sayılan her türlü hususlar nedeniyle, Medicasimple’un doğrudan faaliyeti yahut çalışanlarının eylemi neticesinde veya dolaylı (kar kayıpları, veri kayıpları, yetkisiz erişimler, avukat ücretleri de dahil ama bunlarla sınırlı olmamak üzere) olarak ortaya çıkabilecek -ve netice itibariyle Medicasimple, ortakları, çalışanları, yöneticileri, tedarikçileri veya temsilcileri tarafından Müşteriye ödenmesi gerekecek- maddi, manevi, müspet ve menfi tazminat tutarlarının, tazmin talebinin yapıldığı günden önceki doksan (90) takvim günlük sürede Medicasimple’un Müşteriden tahsil etmiş olduğu ücretler toplamını aşmayacağı hususunda kesin, kayıtsız ve şartsız olarak mutabık kalmışlardır.
Müşteri, Medicasimple web sitesinde yayınlanan Medicasimple Gizlilik Politikası’nı okuyup onayladığını beyan eder.
İşbu sözleşme çerçevesinde toplanacak ve Medicasimple tarafından muhafaza edilecek başta kişisel veriler olmak üzere her tür veri taraflar arasında gizlilikle muhafaza edilecektir.Şu kadar ki taraflar,
konularında kesin olarak mutabakata varmıştır.

peşinen beyan ve kabul eder:
İşbu sözleşme gereğince yapılması gereken her çeşit bildirim, Müşteri’nin Medicasimple’a bildirdiği iletişim adreslerine gerçekleştirilecektir. İletişim adreslerinin (elektronik ve fiziki) güncel tutulması Müşteri’nin sorumluluğundadır. Müşteri, Medicasimple’lainfo@medicasimple.come-posta adresini kullanarak veyahttps://medicasimple.comadresindeki iletişim formu veya güncel iletişim bilgilerinden faydalanarak iletişime geçebilir.
İşbu sözleşme onaylandığı anda yürürlüğe girer ve 1(bir) yıl sürelidir.
Medicasimple veya Müşteri, işbu sözleşmeyi dilediği zaman, önceden haber vermeden ve sebep göstermeden fesih edebilir. Taraflardan birinin akdi sorumluklarına aykırı hareket etmesi diğer tarafa akdi derhal fesih hakkını sağlar.
Taraflar Sözleşmenin süresi bitmeden 15 gün önce Sözleşme’ye devam etmeyeceğini bildirmemesi halinde, Sözleşme 6 ay daha uzamış sayılır. Sözleşme’nin uzaması halinde Hizmet Sağlayıcı’nın, sözleşme uzama tarihinde Internet Sitesi’nde mevcut olan Kullanıcı Sözleşmesi hükümleri, işbu Sözleşme hükümlerinin yerini alır. Fesih usulü sonraki 6 aylık dönemler için de uygulanır. Her uzama döneminde ücrete TÜFE – ÜFE ortalamasında zam yapılır.
Fesih veya sonlanma durumunda, tarafların fesih veya sonlanma tarihine kadar ortaya çıkmış borç, alacak ve akdi sorumlulukları geçerliliğini koruyacaktır. Fesih ve sonlanma durumunda Medicasimple, sözleşmenin süresi boyunca toplanan verileri dilediği süre boyunca muhafaza etme ve işbu sözleşmenin “Verilerin Gizliliği” bölümünde ve sair maddelerinde ifadesini bulduğu üzere, anonimleştirerek kullanmak haklarını saklı tutar. Aksi Medicasimple tarafından tek taraflı olarak kararlaştırılmadıkça veriler fesih gününü takip eden altıncı ayın sonunda silinir.
İşbu sözleşmeden doğabilecek uyuşmazlıkların çözüm mahalli İSTANBUL (ÇAĞLAYAN) Mahkemeleri ve icra daireleridir.
